A bank or independent guarantee is a document that confirms the need for a bank (guarantor) to pay a certain amount of money to the customer in case the supplier fails to fulfill its contractual obligations.

Subjects of relations under an independent (bank) guarantee:

• Guarantor — bank, credit and commercial organizations;
• Principal — contractor / supplier;
• Beneficiary — customer.

Bid Security Guarantee (Tender Guarantee) is required for a supplier to ensure its reliability when submitting a bid for participation in a tender. In case of refusal to conclude a contract, the bank reimburses the customer for damages: the costs of organizing and conducting a new tender.

Contract fulfillment guarantee is required by the supplier when signing a contract and guarantees that obligations under the contract will be fulfilled on time and in a quality manner. It is used in both commercial and government contracts (44-FZ/223-FZ/185-FZ (615-PP)) etc.

An advance payment refund guarantee is a formal obligation of the bank, which confirms that if the contractor fails to fulfill the terms of the contract, the bank undertakes to return the advance payment to the customer. If the advance payment is not stipulated in the contract, the customer can be offered to conclude an additional agreement with the stipulated advance payment secured by the guarantee.

Warranty guarantee ensures the quality of goods, works, or services for the warranty period. The supplier provides it to the customer to confirm quality commitments.

Obtaining a proposed bank guarantee takes about 15 minutes if the principal company has a full package of documents and no overdue financial obligations in other banks. The commission fee is paid directly to the bank, without intermediaries.

In bank collateral, only banks act as guarantors, while independent guarantees are also provided by other legal entities.

Organizations that issue independent guarantees under the 44-FZ:

• SME Assistance Funds issue independent guarantees to small and medium-sized companies;
• ВЭБ.РФ Development Corporation;
• Eurasian Development Bank — to suppliers from EAEU countries (excluding Russia);
• Banks from the list of the Russian Ministry of Finance — to other procurement participants.

The cost of an independent (bank) guarantee is equal to the cost of the commission fee, which is set individually by each bank. The minimum commission fee is currently 950 rubles.

The platform does not charge a fee. Commission for independent (bank) guarantees is paid to the bank.

To execute an independent (bank) guarantee, the participant of the procurement should provide the guarantor with the following set of documents:

1. Guarantees under 44-FZ and 223-FZ up to 5 million rubles

• Company card — a document containing basic information about the organization (name, address, contact details, etc.).
• Scan of passport of the head and founder (2, 3 pages and propiska) — copies of passport pages containing personal data and registration address.
• Procurement number in the Unified Information System — a unique procurement number assigned to it in the Unified Information System.
• For JSCs, an extract from the register of shareholders is additionally required — a document containing information on the composition and structure of shareholders.

2.Commercial guarantee

• Company card — a document containing basic information about the organization (name, address, contact details, etc.).
• Accounting reports (annual for 2023, and 2nd quarter of 2024).
• Scan of passport of the head and founder (2, 3 pages and propiska) — copies of passport pages containing personal data and registration address.
• Resolution (protocol) on appointment of the General Director (if the powers have been extended, then the resolution on extension).
• Statute of the legal entity — the founding document of the organization.
• Register of executed contracts for the last 3 years (3-5 of the largest ones).
• Procurement documentation (Scan/draft contract) - copy/draft of the contract for the supply of goods, work, or services.
• For JSCs, an extract from the register of shareholders is additionally required — a document containing information on the composition and structure of shareholders.

3. Guarantee under 44-FZ and 223-FZ over 5 million rubles:

• Company card — a document containing basic information about the organization (name, address, contact details, etc.).
